SPOKANE VALLEY- According to reports a suspect was arrested for burglary and malicious mischief on September 9.
In the afternoon of September 9, Spokane Valley Deputies and a SWAT team worked together to locate and safely arrest a multi-time convicted felon on new charges stemming from an incident that took place earlier in the day.
Records show a second person was also contacted and arrested for a valid felony Idaho warrant. The suspect, Dwayne J. Tolbert, 32, was taken into custody after a SWAT team was given a valid search warrant after Tolbert refused to surrender to Spokane Valley Deputy Stephan Blaakman.
Reports show the arrest took place on the 13300 block of E. 4th Avenue after Deputy Stephan Blaakman identified the suspect as Tolbert. After surveilling Tolbert's residence, Deputy Blaakman established and PA announcements were given, instructing Tolbert to surrender peacefully and exit the home with his hands up. Tolbert ignored the commands and refused to exit, leading to the request for a search warrant and the SWAT team's assistance, due to Tolbert's history of being a multi-time convicted felon known to be armed.
The incident began when the victim confronted a female, later identified as Brandy G. Fry, 31, and believed to be Tolbert's girlfriend, about some money she owed him. An argument between Fry and the victim ensued before the victim left according to reports.
Later, Tolbert went to the victim's apartment, entered without knocking or permission, and began yelling the victim's name. When the victim moved to his front room, he saw Tolbert standing inside his apartment, holding a metal baseball bat by his side. They argued about the debt and the earlier incident, which ended with the victim telling Tolbert to leave. Tolbert held the bat above his head and threatened the victim before leaving the location.
Once outside, Tolbert put on a gold mask, reports say, and walked over to the victim's vehicle, and smashed the window with the bat before leaving on foot. Brandy G. Fry was also arrested, and a check of her name revealed a valid Kootenai County felony warrant for her arrest.
Tolbert and Fry were transported and booked into the Spokane County Jail. Tolbert was charged with Burglary 1st Degree, Harassment-Weapon Involved, and Malicious Mischief 3rd Degree. Fry was booked as a Fugitive from Justice for her Idaho Felony Warrant.
